MyChart Terms and Conditions

This web site ("Site") and related services are provided by HealthEast Care System ("HealthEast") to its patients subject to compliance with the terms and conditions set forth below. Please read the following information carefully. Your continued use of MyChart will indicate your agreement to be bound by the terms and conditions set forth below. Use of MyChart is voluntary and you are not required to use MyChart. If you do not agree to be bound by these terms and conditions, promptly exit this Site.

I. Privacy

Your privacy is of the utmost importance to us. HealthEast will use your confidential medical information in order to provide you with health care services. HealthEast will, at all times, maintain your confidential medical information in strict confidence and will not disclose any information regarding you to any unaffiliated third party unless you authorize that person to receive your information or the information is permitted to be disclosed by law. Please review HealthEast's Notice of Privacy Practices for a thorough description of how we gather, use, and protect your confidential medical information. All messages sent and received within MyChart that contain medical information are subject to all state and federal laws governing the security and confidentiality of medical records.

II. MyChart Features

A. Electronic Messaging

MyChart's messaging system is not an emergency response system and is not to be used as a substitute for calling 9-1-1 or for seeking immediate medical attention at my local emergency room in the event of an emergency. HealthEast providers and staff will make their best efforts to respond to messages submitted via MyChart within one (1) business days; however, timely responses are not always possible. Accordingly, urgent and/or emergent messages should not be submitted via MyChart.

If your provider is out of the office or unavailable, messages sent via MyChart may be routed to other providers within HealthEast in order to facilitate a timely response to your request.

B. Secure Communications

All communications between you and HealthEast providers using MyChart occur over a secure connection. You will receive Internet e-mail messages notifying you that new information is available in your MyChart account. The notification itself does not contain any medical information; however if you do not want others to see the notification, it is your responsibility to take appropriate precautions.

C. Access Code

When you initially enroll in MyChart, you will be provided with an access code. The access code you receive will give you the opportunity to create a personal login name (called "MyChart ID") and a password. Once this access code has been used it will no longer be valid. It is extremely important that you keep your login name and password completely confidential. Anyone with access to your login name and password will be able to access your confidential medical information. That person will also be able to read your messages and send new messages as if they were you. It is your responsibility to prevent disclosure of your login and password, and to change your password if you feel that your password has been compromised. You may change your password at any time. It is also your responsibility to log out of active MyChart sessions and take appropriate precautions when accessing MyChart from a home, business, or public computer and when printing or copying any MyChart medical information.

D. eVisits

An eVisit is an online exchange of medical information between a patient and their provider whereby the provider gives the patient medical advice via secure online communications. When initiating an eVisit, you must accept the MyChart Terms and Conditions, verify your information, and complete an online questionnaire about your symptoms.

eVisits can be used only for the non-urgent symptoms identified on the eVisit reporting form. There will be an associated charge for an eVisit. Providers will provide medical advice via the secure MyChart portal. At any time during the eVisit, the provider may terminate the eVisit and advise the patient to seek treatment from an in-person provider visit, or if symptoms described are emergent, to seek care from the closest emergency room.

III. Information Does Not Constitute Medical Advice

HealthEast assumes no responsibility for how you use the information you obtain from this Site. You should consult with a physician or other health care provider regarding your own condition and how this Site content may or may not apply to you.

You may be accessing your own medical information via the MyChart application and may wish to communicate with one of your health care providers about that or related information. If you have an emergency, or think you need to speak to someone urgently, please do not use the email communication options provided to you by MyChart. Neither MyChart nor any other application available through this Site is a substitute for appropriate and timely contact and consultation with your physician. You should never change or stop any course of treatment prescribed by your physician without first consulting him or her.

IV. Links to Other Sites

HealthEast makes no representations whatsoever about any other web site that you may access through the site or any entity that may post its advertisements on the Site. When you access a non-HealthEast site, please be advised that it is independent from HealthEast, and that HealthEast has no control over the content on that web site. HealthEast does not endorse or accept any responsibility for the content or use of any other linked site. If you decide to access any third party sites linked to the Site, you do so entirely at your own risk.

V. Termination of Access

MyChart is provided as a convenience to patients. HealthEast has the right to restrict or deactivate access any time for any reason or for no reason. If access is restricted for planned maintenance of the MyChart system, every effort will be made to communicate downtime to all users in advance. However, there may be times when reasons to restrict access to MyChart will be restricted without advance notice.

VI. Restrictions on Use and Ownership

All pages within the Site and any material made available for download via the Site are the property of HealthEast and/or its subsidiaries and affiliates. The content on the Site is provided for HealthEast and its patients only. The words "HealthEast" and its associated corporate logo are the trademarks and service marks of HealthEast Care System. All other trademarks, service marks, and logos used in this Site, including but not limited to MyChart and Epic, are the trademarks, service marks, or logos of their respective owners. Nothing on the Site should be construed as granting any license or right to use any trademark, service mark, or logo displayed on the Site without the express permission of HealthEast or the third party that may own the trademark, service mark, or logo.

VII. Accuracy and Integrity of Information

Although HealthEast attempts to ensure the integrity of the Site, it makes no guarantees whatsoever as to the correctness or accuracy of the Site. It is possible that the Site could include typographical errors, inaccuracies or other errors. In the event that an inaccuracy arises, please inform HealthEast so that it can be corrected. Information contained on the Site may be changed or updated without notice.

VIII. Audits

Activities within MyChart may be tracked by computer audit. Entries and messages by you (the user) and HealthEast providers may become part of the medical record.

IX. Other Terms

HealthEast shall not be liable for any damages suffered by the user or other third parties related, directly or indirectly, to the material and information contained in MyChart. In no circumstances will HealthEast be liable to the user or any other person for direct, indirect, special, incidental or consequential damages of any type, even if informed of the possibility of such damages. HealthEast cannot guarantee access to the MyChart system and is not liable for the user's inability to access or view the information contained on the Site. By downloading or viewing the information on MyChart, the user agrees to hold HealthEast harmless and indemnify it against any damages, claims, or other claims asserted against HealthEast arising out of, or in any way connected with, the user's utilization of MyChart or the information contained therein.

The terms of this Agreement may be changed at any time in the discretion of HealthEast and updated terms will be posted on the MyChart website for user access.
